1. Agreement to Terms

By accessing or using the Theroux platform at theroux.io (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Theroux is a SaaS platform that provides automated UX audits with revenue attribution. The Service analyses URLs you provide by capturing screenshots, identifying friction points using AI, and calculating estimated revenue impact based on data you supply (traffic, conversion rates, ARPU).

3. Account Registration

To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account and keep it up to date.

4. Subscription and Billing

  • Theroux offers multiple subscription tiers (Free, Starter, Growth, and Agency) with varying features and limits.
  • Paid subscriptions are billed monthly or annually through Stripe. Annual plans include a discount equivalent to two months free.
  • You may upgrade, downgrade, or cancel your subscription at any time through your account settings. Changes take effect at the start of the next billing cycle.
  • Refunds are handled on a case-by-case basis. Contact us at support@theroux.io for refund requests.

5. Acceptable Use

You agree not to:

  • Use the Service to analyse URLs you do not own or have permission to analyse
  • Attempt to reverse-engineer, decompile, or disassemble any part of the Service
  • Use the Service in any way that violates applicable laws or regulations
  • Share your account credentials or allow third parties to access your account beyond your subscription's seat allowance
  • Submit malicious URLs, content, or data designed to exploit or harm the Service
  • Resell, redistribute, or sublicence access to the Service without prior written consent

6. Your Data

You retain ownership of all data you submit to the Service, including funnel data, URLs, and associated metrics. By using the Service, you grant Theroux a limited licence to process this data solely for the purpose of providing the Service to you.

Audit results generated by the Service are provided for your use under your subscription. You may export, share, and use these results within your organisation.

7. AI-Generated Analysis

The Service uses artificial intelligence to analyse screenshots and generate UX recommendations. AI-generated outputs are estimates and recommendations, not guarantees. Revenue impact figures are calculated based on the data you provide and industry benchmarks. Actual results may vary. You should use professional judgement when acting on any recommendations.

8. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by Theroux Inc. and protected by intellectual property laws. These Terms do not grant you any right to use Theroux's trademarks, logos, or branding without prior written consent.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will endeavour to provide advance notice of planned downtime.

10. Limitation of Liability

To the maximum extent permitted by law, Theroux Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or available at all times.

12. Indemnification

You agree to indemnify and hold harmless Theroux Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting updated Terms on this page and updating the “Last updated” date. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
